If people have already enjoyed free and unencumbered access since time immemorial...

In this case, it looks truly like a gradual shift in the title of the land, but where no-one thought to officially sort out access to a PCP that has stood there for years.

If true, then it is right for Bt to attempt to sort out access on the basis that they've already had access forever. And right that the owner doesn't get anything beyond a token payment.
I was thinking, that were they available, the historical pre-registration documentation would be very interesting. Be funny if he'd been sold something that wasn't in the vendor's gift. >:D

Looks like the PCP is just on his land from that, but it must of been there when he bought the house in July 1998, so he can hardly complain about them needing access.

It's a good job there's a driveway at the side. There'd be no legal right to drive on and off at the front, as the land doesn't meet the highway. That would've made an incentive to negotiate.
