SCO lose Unix case against Novell
« on: August 11, 2007, 08:10:35 AM »

The long-running and acrimonious case by SCO against Novell for the ownership of the Unix and Unixware copyrights has been resolved in Novell's favour. See http://www.groklaw.net/article.php?story=20070810165237718 for details. This almost certainly means that their case against IBM will also fail. For us Linux types this is brilliant news! :)

This has been a very long ongoing battle hasnt it?

iirc there was accusations that Linux was way too unix based..  and didnt M$ (surprise surprise) get involved in the legal funding somewhere... Im afraid Im not up to date or aware of everything that went on around this particular case.

Good news for the open source community...  and hopefully now that "some of it" has been resolved... my only concern is that could Novell become too greedy at some point in the future?

It's widely believed that M$ bankrolled the lawsuits originally but withdrew their support when it became pretty clear that SCO wasn't going to win much, if anything. Of course this may just be the conspiracy theorists at work.

It's an incredibly complex story, and Groklaw has been following it all the way, but you need to be a lawyer with several ice packs on your head to take in all the detail.

Novell are generally reckoned to be good guys in the Linux world, although their recent licensing deal with M$ didn't go down so well.

Just a quick glance at that summary has sent me rushing to the freezer for a bag of frozen peas. And very fetching I look!

Good news in part, at least :)

To be honest I'd forgotten about that, not being a linux world news follower - but I did know about it, and I'm glad the decision has gone that way.

iirc

What does this mean Kitz? I often see it, and the best I come up with is "in Internet relay chat".

I know that it's unseemly to gloat, but I can't help feeling pleasure that SCO are close to complete failure.

http://arstechnica.com/news.ars/post/20070918-sco-has-substantial-doubts-about-its-ability-to-survive.html

This company took action which, if successful, would have effectively destroyed Linux as a free open source operating system. When they first launched the lawsuits against IBM and Novell, some small companies even paid them royalties just to save themselves from the threat of legal action, even though it's now been shown that SCO didn't own the rights. I feel sorry for their employees of course, but I'll be popping the champagne corks when SCO finally collapse.
