Yes, the graphs you have provided do suggest 'issues'.

However, if you are on a 40/10 service, I can't see your ISP being willing to arrange an engineer's visit as you are in sync at 40/10 already.

Even on the 80/20 service I believe the FTR (Fault Threshold Rate) is ridiculously low (maybe 30Mb).
As you are already exceeding that, you would have an uphill battle to convince any ISP that you actually have a "service affecting" issue.
Comparing your connection against a neighbour's isn't classed as a good enough reason to instigate an engineer's visit.

What makes matters worse is that you are not even supposed to see your connection's stats, never mind complain about them.

If you are supposedly on the 80/20 service, then it would appear your profile firstly needs resetting.
That is something you could legitimately complain about.
